We, Formosa International Hotels Corporation, FIH Management Limited, together with our affiliates and subsidiaries that form the Silks Hotel Group (collectively, the “Group”) are committed to protecting your Personal Information and your privacy. This Policy explains how and why we gather, store, share and use your Personal Information, as well as sets out the options you have as to when and how you choose to share your Personal Information.

“Personal Information” is information or data, recorded in any format that identifies you personally either by itself or together with other information that is made available to us.

This Policy does not apply to the practices of businesses or websites we do not own or control, nor does it apply to the people we do not employ or manage.

Our site (“Website”) may contain links to other websites that are operated by third party companies or individuals with different privacy practices. You should exercise caution when you leave our Website and review the privacy statements of other websites. We have no control over the Personal Information you may submit to these third parties, and we do not accept any responsibility or liability for their privacy statements, policies or how such third parties manage the data they collect.

You are not required to provide any Personal Information to us if our request for your Personal Information is based on your consent, i.e. not based on legal requirements. You can always withdraw your consent at any time afterwards. To withdraw your consent, please see section on How to Contact Us with Questions or Concerns about our Privacy Practices. However, if you elect not to supply to or withdraw the data from us, we may not be able to deliver the products and services you desire, and this may also result in the automatic termination of any agreements you may have with the Group.

If the EU General Data Protection Regulation (“GDPR”) applies to you, you have certain legal rights and these are set out in the section on Access to your Personal Information. At the time of collecting your Personal Information, we will inform you of:

  • our contact details;
  • the purpose for the collection and the legal basis for doing so;
  • if applicable, our legitimate interests for collecting your Personal Information;
  • any third parties or the categories of the third parties who will receive your Personal Information;
  • transfer of Personal Information to any country or organization outside EU, and the appropriate safeguards we apply when doing so, and where you can have access to such safeguards;
  • the criteria we use to determine the period for which your Personal Information will be stored;
  • your right to request access to, rectification, erasure of Personal Information or restrictions or objections to processing;
  • your right to withdraw your consent any time if you provide Personal Information based on your consent;
  • your right to lodge a complaint with a supervisory authority in EU member state;
  • whether you are obliged to provide the Personal Information, and the possible consequences of failure to provide such information; and
  • whether we process any automated decision-making, including profiling based on the Personal Information you provide.

However, if you have already previously been informed of the above information, we may not provide further notification of the same.

Under GDPR, if your Personal Information is submitted to us from a party other than yourself, in addition to the above information, we will inform you of the categories of Personal Information concerned and where we obtained your information within reasonable period after obtaining the information. However, if you are already aware of the same, or we are required by law to obtain the information, or the provision of such information to you will involve disproportionate efforts to achieve, we will not provide you with the above details.

For those of our customers to whom GDPR is not applicable, if we receive information from a party other than yourself (such as in special programs where members of guest loyalty programs refer a friend to us), we will only use that information for the specific reason for which it was provided. Consent

This Policy forms part of the terms and conditions governing your use of our services. By using our Website, central reservation service, staying at any of our hotels, use of any of our products and/or services, or by participating in one of our programs, you are agreeing to this Policy.

When is your Personal Information Collected?

We will collect your Personal Information when you are involved in any hotel activities. For example, your Personal Information will be collected each time you reserve a room, at check-in, staying at any of our hotels and/or enjoying any of our hotel services and facilities (including partaking of any food and/or beverage at any restaurant outlets, using the spa, gym or health centres) and when making payments or providing guest comments or feedback.

In addition, we may collect your Personal Information when some internet activities are initiated. For example, at times when you visit our Websites, we may collect information through our third party service providers' use of technologies, such as pixels or other tracking tools and similar technologies. When you fill in any of our online forms (such as for online reservation or questionnaires), your information may be collected as well. Further, if you make reservations or apply for membership programs offered by the Group or our hotels, the Personal Information you provide will be automatically collected by our third party system service provider(s) due to the nature of the system’s design and operation. Given the similar design of the systems, our advertisement service provider, business intelligence tool provider, marketing tool provider, channel manager service provider, shopping cart and restaurant questionnaire service provider, room and restaurant reservation service provider, and Google Analytics will also automatically collect your Personal Information while you visit our websites. When you opt to participate in our marketing programs, your Personal Information will be collected. For example, if you sign up for any of our loyalty programs, participate in customer surveys, take part in online games or competitions, or subscribe to newsletters, request to receive offers and promotions via email or other channels. We also obtain your information by transmissions from third parties. Such third parties include, tour operators, travel agencies (online or not), and others. We may collect Personal Information about you from other companies that have the right to share information with us. We may also enter into strategic relationships with companies outside of the Group (our "Strategic Partners") who offer products and services that may be of interest to you such as airlines, hotel partners, travel operators and travel agents. If you participate in these programs, our Strategic Partner may send us Personal Information about you as part of our strategic relationship.

What is the Personal Information We Collect?

We will collect and process some or all of the following personal data about you:

  • Information about you such as your name, date of birth, nationality, contact details including email address and telephone number, travel document, photographs and other images.
  • Payment details used to pay for rooms and our other products and services, such as credit or debit card numbers and expiry dates, account information and billing information.
  • Travel information such as your travel itinerary, hotel selection, room and other service preferences, special needs and interests, choice of tours, car rentals and other add-ons to your travel package, for example, when you book a reservation through our central reservation service, stay at any of our Group hotels, or when you modify your personal profile. We may collect and handle sensitive Personal Information, for example, when we handle requests for special medical or access assistance or specific dietary requirements which may indicate your religious beliefs. We will typically ask you for your consent when collecting and handling this type of Personal Information, unless we are otherwise permitted to process such personal data under applicable laws.
  • Information about your use of our products and services such as historical travel arrangements, feedback about your experiences and preferences, and images captured via CCTV in the public areas of our hotels.
  • Our interactions with you – We will keep records of any interactions and correspondences between us such as calls made through our call centres, communications you have with our staff or representatives and any interactions with us or posts that refer to us on social media or other public sources, as well as your responses to market surveys and contests conducted by us or on our behalf.
  • Details of your visits to our Website, use of our mobile applications and other data collected through cookies and other tracking technology including information that you view. Your Personal Information may be automatically collected when these tracking technologies are applied. The information so collected may be used for aggregated trend and statistical analysis, and for showing you more relevant advertisements and messages.   • Your IP address and browser type may also be collected. This information is used for our own analytical purposes for enhancement of our services, and is separate from any cookies information which is gathered. Your IP address may be used to assist in preventing criminal activities on the Website in certain circumstances.
  • Employment information – If you are employed by one of our corporate or government clients, or travelling or obtaining products or services in relation to one of our corporate or government clients, we will collect certain information about your employment or relationship with such clients including the name of your employer, your professional title and your work contact information.

We will only collect Personal Information which is relevant and necessary for specific identified purposes (please refer to the section Use of your Personal Information), and we will not use it for any other purposes without obtaining your consent.

We do not knowingly collect Personal Information from children under the age of 13 or minors under the age prescribed by the applicable laws. If you believe your child has provided Personal Information to us, please contact us so that we can identify and delete your child's Personal Information.

Use of your Personal Information.

We will give you choices about the ways we use and share your Personal Information and we will respect the choices you make.

The retention period for Personal Information is based on business needs or legal requirements. We will retain your Personal Information for as long as is necessary for the purposes it was collected. For example, we may (i) keep records of some transaction details and correspondence until the time limit for claims arising from the transaction with us has expired (which might be at most 15 years after the relevant transaction occurred subject to local laws. In most cases, it will be 2 years in Taiwan); or (ii) record your information to comply with regulatory requirements. When the retention period expires, we will either destroy your Personal Information or anonymise it (in which case we may further retain and use the anonymised information for our legitimate interests, such as business analysis).

Choices You Have about the Use of Your Personal Information for Marketing Purposes

We may communicate marketing and promotions to you by post, telephone or online (including by email or through your mobile device or via online banner advertisements). We will ask you for your consent to send you such materials, or you may choose not to receive any marketing communications from us, at the time we collect your Personal Information. Please note that at any time you may withdraw your consent and receive no more marketing and promotions from us. Please see “How to Contact Us with Questions or Concerns about Our Privacy Practices”. We will also provide an option to unsubscribe or opt out of further communications on any direct marketing communications sent to you.

If you choose not to receive any promotional communications from us, we will not send you promotional messages and will not share your Personal Information with other companies for marketing purposes. We will update your privacy preferences within 30 days from receipt of the request.

Please note that some advertisements shown to you when you browse online are displayed by our advertisement service providers. They display promotional messages relevant to you based on your preference they learn through the cookies they embed on our websites. We will not share your Personal Information with our Strategic Partners for marketing purposes without your consent. Provided you agree, we will share your Personal Information with them, so that they may send you news updates, special events, offers and promotions regarding their products and services, including travel, transportation, retail, food and beverage, credit cards, entertainment, social networking, and similar services. If you no longer wish to receive this information from our Strategic Partners, our Group companies and their licensees or third parties, you need to contact them directly.

We may still contact you for customer research or administrative purposes, such as confirming a reservation or transaction you have made, informing you of your account status or inviting you to update your online profile.

Sharing of Your Personal Information

We may share your Personal Information with selected others in accordance with this Policy and only on a need-to-know basis as follows:

We share your Personal Information among our Group hotels and with our other Group companies and their licensees, third parties carefully selected by the Group, Strategic Partners, and/or service providers to provide the information, products and services that you have requested, to send you promotions and special offers they believe will be of interest to you or to personalize your experience. Our sharing is in accordance with this Policy. For example, the following teams may have access to your data: Group hotel staff, reservation staff using Silks Hotel Group reservation tools, IT departments, commercial partners, medical services if applicable, legal services if applicable. Generally, any appropriate person in the Group may have access to certain specific categories of Personal Information for the consummation of contracts between you and the Group.

In addition, we will share your Personal Information with companies that perform services on our behalf, such as companies providing marketing support and technical infrastructure support. They may include: third-party payment processors, payment service providers, banks and financial institutions, credit card companies, IT and marketing support service providers; vendors or third party service providers in connection with marketing promotions and services offered by the Group (please see “Choices You Have about the Use of Your Personal Information for Marketing Purposes”); to our advisors, including our accountants, lawyers, other professional advisors and business contacts for the purposes of better managing or developing our business and legal compliance purposes; and to anyone who may be involved in the process of making your travel arrangements in order to fulfill contractual obligations.

In order to pursue our legitimate interests, whilst safeguarding your rights and liberties, our service providers will use the Personal Information we share with them for the purpose we provide it to them. They must comply with all applicable privacy and data protection laws.

We will share your Personal Information to any other party with your consent and direction or with whom you authorise us to disclose.

We may transfer your Personal Information to another entity that has acquired or may acquire the stock or substantially all of the assets of any of the Group companies, a member of the Group, or one of its or their operating divisions, for example, as the result of a sale, merger, or reorganization, insolvency, dissolution or liquidation. If such a transfer occurs, the acquiring entity's use of your Personal Information will still be subject to this Policy. The legal basis for doing so is the necessity for our legitimate interests in maintaining and improving the quality of services.

There are other limited circumstances in which we may share or transfer your Personal Information to unrelated third parties, including for example, when we believe disclosure is appropriate to comply with a law, regulatory requirement, court order, or a subpoena; to cooperate with law enforcement or other governmental investigations (in whatever jurisdictions); to prevent or investigate a possible crime, such as fraud or identity theft; to protect legal rights, property or safety of you, the Group, our Group hotels, our employees, agents, other guests, or the public in general. We are required to do this in order to comply with our legal obligations.

Special Notification for California residents. Individual customers who reside in California and have provided their Personal Information to Group hotels may request information about our disclosures of certain categories of Personal Information to third parties for their direct marketing purposes. Such requests must be submitted to us at info@silkshotelgroup.com. Within thirty (30) days of receiving such a request, we will provide a list of the categories of Personal Information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to address the specified in this paragraph.

Except as described in this Policy, we will not share your Personal Information with third parties without your consent.

Protection of Your Personal Information

We implement appropriate physical, technical and organizational security for the management and transmission of personal data, including appropriate security measures to protect such data from accidental or unlawful destruction or accidental loss, misuse, alteration, unauthorized disclosure or access and all other unlawful forms of processing.

We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) technology, which encrypts information you input and is certified by the Secure Server Certification Authority and malware scanning.

We reveal only the first six and last four digits of your credit card numbers when confirming a reservation or processing on-line purchase transactions. However, we transmit the entire credit card number to the appropriate credit card company for verification. All transactions are processed through third party hotel reservations provider and are not stored or processed on our servers.

Access to Your Personal Information

When you exercise any of the following rights, we will respond to your request within 30 days and, in any event, within the time period established under applicable laws.

We provide ways for you to access your Personal Information so that you can correct inaccuracies. You may update, delete, or correct your key account information at any time by visiting your online profile or by contacting us. If you have any request regarding obtaining a copy of your Personal Information, transferring your Personal Information to a third party, objection to certain processing of your Personal Information or being subject to profiling and automated decision-making or have additional questions, please see How to Contact Us with Questions or Concerns about Our Privacy Practices for more information.

When contacting us, you may be asked to verify your identity. We may limit or deny your request if we are unable to verify your identity, if it involves the disclosure of confidential or sensitive information or there are any other restrictions under applicable law.

You have legal rights under GDPR in relation to your Personal Information:

1. Right to Accession

You can ask us to confirm whether we are using your Personal Information. You may request us to provide the categories of your Personal Information which you are concerned about, the purpose of our use, if there is any third party who will obtain your Personal Information, the category of such third party, and other essential information related to our use. You may also request for a copy of your Personal Information which we have on our records.

2. Right to Correction and to be Forgotten

If you discover that the Personal Information you provided is inaccurate or incomplete, you may ask us to correct the same. Please understand that we may first be required to verify the accuracy of your information before we proceed with making any corrections.

Unless otherwise to establish or defend legal claims or necessary for compliance with applicable laws, you may ask us to delete your Personal Information if:

  • the purpose for the collection no longer exists;
  • you wish to withdraw your consent on use of any information which was previously provided or obtained with your prior consent;
  • if your Personal Information is used for direct marketing purposes and you no longer wish to receive such materials;
  • where your Personal Information is used unlawfully; or
  • where we are subject to a legal obligation to erase your Personal Information.

Right to Restrict Use of Personal Information

You have the right to restrict our use of your Personal Information in any of the following circumstances:

  • when you have concerns on the accuracy of Personal Information and we need time to verify the same;
  • you do not want to erase your Personal Information notwithstanding that the use is unlawful and want to restrict the use instead;
  • we no longer need your Personal Information but you require the information to establish, exercise or defend legal claims;
  • if you object to our use of your Personal Information but we still need to confirm if we have overriding legitimate interests to use it.

In the case described in sub-Section 2.(Right to Correction and to be Forgotten) and 3 (Right to Restrict Use of Personal Information), where it is possible and does not involve disproportionate efforts, we will communicate to the persons or entities to whom we have disclosed your Personal Information regarding your requests.

4. Right to Data Portability

If permitted by applicable laws, when we obtain your Personal Information based on your consent, for the purpose of performing a contract to which you are a party or about to become a party, or our processing of your Personal Information is carried out by automated means, you have the right to ask us to provide you with your Personal Information in a structured, commonly used, machine-readable format. In addition, you may ask to have your Personal Information transferred directly to another personal information controller (e.g. another company) if the Personal Information we hold is in digital and transferrable form.

5. Right to Object to the Use of Personal Information

If we are processing your Personal Information based on legitimate interests, unless we are able to demonstrate we have compelling reasons for the processing that override your rights, you may object to the processing and request for deletion of your information. We can continue using your Personal Information if there is a need to establish or defend legal claims. You can also prevent us from using your Personal Information for direct marketing purposes.

6. Right not to be Subject to Decisions based Solely on Profiling

Save where we obtain your Personal Information based on your consent, on EU law, or if we need to process your Personal Information to perform a contractual obligation between you and us, you have the right not to be subject to any decision made based solely on automated processing, including profiling. However, if the profiling is made based on your consent or any contract with us, you have the right to express your views on such decision and/or withdraw your consent.

7. Right to be Informed of any High Risk due to Potential Personal Information Breach

If there is any Personal Information breach and the breach may potentially expose you to risk of unauthorized access of your Personal Information, we will communicate such breach to you.

There may be situations where we may not inform you of a breach such as:

  • we have implemented appropriate protection measures;
  • we have taken subsequent measures to ensure your exposure to any risk of unauthorized access to your Personal Information no longer exists; or
  • such notification to you requires disproportionate effort to achieve. However, in such instance, we will take steps to inform you by way of public or similar communication measures to ensure that you are effectively informed.
Transfer of Personal Information to other Countries

The nature of our business and our operations requires us to transfer your information, including personally identifiable information to internal or external recipients, e.g. other groups, companies, data centers or service providers that may be located in countries outside of yours. Our Website currently resides on servers in Tokyo, Japan and our databases are located in Taipei, Taiwan, but we may at times use supplemental facilities located outside of these two locations.

Different countries have different data protection laws, some of which provide more protection than others. Although the data protection laws of these various countries may not be as comprehensive as those in your own country, the Group will take appropriate steps to ensure that your Personal Information is protected and handled as described in this privacy statement. To comply with GDPR, when Personal Information is transferred to countries outside of the EU which have different levels of personal data protection from EU, such transfer will be regulated by standard contractual clauses defined by the European Commission.

By using our Website, participating in our programs, or staying at our Group hotels, you are consenting to the transfer of your Personal Information to any country in the world in accordance with the terms of this Policy.

Web Technologies Used to Passively Collect Information about You

Most major websites and mobile applications automatically receive and record information on their server logs from browsers when the website or mobile application is accessed. In the case of our Website and mobile applications, we have third party service providers who do this through use of a variety of methods, including tracking pixel and cookies (as further explained below) and other tracking tools or similar technologies, to collect this information.

Cookies

A Cookie is a small text file containing a string of information that a website server stores on a visitor’s computer hard disk and that the visitor’s browser provides certain information to the website server each time the visitor returns.

When you visit our Website, information is automatically and directly sent to our third party service providers by your web browser. This information typically includes:

  • the IP address of your internet service provider
  • Cookie information
  • Unique device user ID
  • Browser type and operating system installed on your computer
